These Terms and Conditions govern your purchase of one of the programs in the Elite Kickstart Program, which includes Elite ACT Weekend Kickstart, Elite SAT Weekend Kickstart, Elite ACT After School Kickstart, Elite SAT After School Kickstart, and Elite Kickstart Practice Tests (collectively, “Elite Kickstart Program”) from Elite Education USA, Inc. (“Company”). By purchasing the Elite Kickstart Program from this Site or contacting Company directly, you are indicating your acknowledgment and acceptance of these Terms and Conditions.


For purposes of these Terms and Conditions, a "Student" is someone who has not reached the age of majority in the applicable jurisdiction from which this Site is being accessed. You agree that the Elite Kickstart Program provided by Company is only directed to Students who have not graduated from high school. No other attendees are permitted during class sessions, including Student’s parents and legal guardians as well as Student’s relatives, siblings and friends who have not registered for the scheduled Elite Kickstart Program.


In the event that you, as Student’s parent or legal guardian, wish to allow Student to use the Site and/or any Company services, you acknowledge that that Student will have permission to access this entire site and any Company services, including without limitation the Elite Kickstart Program.  

You expressly understand that Company is not an out-of home care provider and will not provide care services, including but not limited to providing babysitting, transportation (“pick up”) service, medicine, or food. Moreover, Company is not responsible for supervising Student during the Elite Kickstart Program. 


Payment for the Elite Kickstart Program must be made by credit card, and Company accepts the following credit cards: Visa, Mastercard, and Discover. Full payment must be received by Company no later than 48 hours in advance of start of the Elite Kickstart Program. Payments on the start day of the KICKSTART Program are not accepted. 


Cancellations must be made at least 48 hours prior to the scheduled Elite Kickstart Program. Company does not issue refunds, credits or discounts if Student can only attend a portion of the Elite Kickstart Program. Furthermore, Student’s registration for the Elite Kickstart Program may not be split with or transferred to another Student.


The educational materials provided by Company (the "Materials") in the Elite Kickstart Program is the proprietary information of Company, and Company retains all right, title, and interest in the Materials. The Materials may not be copied, distributed, republished, uploaded, posted, or transmitted in any way without the prior written consent of Company. You may not remove or alter, or cause to be removed or altered, any copyright, trademark, trade name, service mark, or any other proprietary notice appearing on any of the Materials. Further, Student may not video tape or record any session of the Elite Kickstart Program.


Student should dress in appropriate and neat manner. No bare feet, tank top, and gang-related attire will be allowed. Student shall respect all other individuals while attending the Elite Kickstart Program, including instructors, staff members, and other students. Student shall refrain from engaging in disruptive behavior in class including but not limited to answering cell phones, texting, listening to audio devices, and playing video games. Further, Student shall not bring food or drinks into the room where the Elite Kickstart Program is conducted. Company reserves the right to remove a Student who violates the Student Code of Conduct from the Elite Kickstart Program. No refund or credit shall be issued by Company if Student is removed from the Elite Kickstart Program for violating the Student Code of Conduct.


We shall not be in default if the scheduled Elite Kickstart Program is delayed or rendered impossible by acts of God, war, civil commotion, governmental action, fire, storm, flood, explosion, strikes, walkouts, other industrial disturbances, or any other cause beyond the control of the Company. In the event of an unforeseen cancellation of the Elite Kickstart Program due to one of the causes listed above, Company will issue a full refund to you.
Except as otherwise stated herein, any controversy, claim or dispute arising out of or relating to this Agreement or the breach, termination, enforceability, or validity thereof, including the determination of the scope or applicability of this Agreement to arbitrate, shall be determined and settled by arbitration in Los Angeles, California before a sole arbitrator and administered under the auspices of the American Arbitration Association’s ("AAA") then current AAA Commercial Arbitration Rules. Judgment on the award rendered may be entered in any court having jurisdiction. Upon request of either party, mediation shall be conducted prior to the arbitration pursuant to the mediation rules of the AAA. Any appointed arbitrator shall have the right to award attorney’s fees to the prevailing party. This provision shall not restrict, however, either party’s right to obtain injunctive relief to enforce any provision of these Terms and Conditions in any court of competent jurisdiction. If any part of these Terms and Conditions is unlawful, void or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions. These Terms and Conditions constitute the entire agreement among the parties relating to the Elite Kickstart Program.
